The advocacy as the very important instruments of the Supremacy of he Law, has not yet created in Ukraine in accordance with the requirements of independent profession, Ukraine’s Justice Minister Sergey Golovaty stated speaking in the International Seminar “Reformation of advocacy and free of charge system of legal assistance in Ukraine.”
“After ten years Ukraine became the member of the European Council and the Constitutional Institute of Advocacy was created, Ukraine still has not had independent and professional organization of legislature establishment,” mentioned Justice Minister of Ukraine. “That is why Ukrainian institute of advocacy along with non-reformed legal institutes of investigation and prosecution become a problem under conditions of absence of administrative system of legal procedure. Ukraine faces these problems within the context of formation of legal system,” added Sergey Golovaty.
Nowadays the solution of the problem stands on the new qualitative stage. “Verkhovna Rada of Ukraine registered new draft bill “On Advocacy.” It must be considered by profile committee in the nearest future,” pointed out Golovaty.
He also stressed that after the draft would be through the first consideration it would be socially discussed. The representatives of advocatory profession will be involved in thoroughly elaboration of it.
The draft bill will be sent to the Council of Europe for expertise. The amendments of the experts will be taken into account when the draft will be considered for the second time.
