Ukraine's Cabinet of Ministers has approved at its regular meeting the draft amendments to the Law of Ukraine "On state market supervision and control over non-food products," the Information-Analytical Bulletin of the Cabinet of Ministers of Ukraine informs.

As explained by experts from the Ministry of Economic Development and Trade, the legal and institutional framework for the state market supervision and control over non-food products is now established by the Law of Ukraine "On state market supervision and control over non-food products."

In accordance with the provisions of the Law, the purpose of market supervision is the implementation of restrictive (corrective) measures concerning products which do not conform to established requirements.

At the same time, representatives of the state market supervision often face the attempts of business entities (manufacturers or distributors) to obstruct the examination of products to be sold or ignore the legitimate demands of the officials.

Experts say these actions are usually associated with attempts to avoid responsibility for introduction into circulation or distribution of products that pose a threat to the safety of life, health and environment. In this case the perpetrators make use of the gap in the law. A liability is established for non-compliance or incomplete compliance with the decision on the adoption of restrictive (corrective) measures, as well as for failure to comply with the immediate elimination of violations.

Liability also is not established for obstruction of the examinations of non-food products or non-compliance with the requirements of officials established by law.
