The Superior Specialized Civil and Criminal Court of Ukraine has postponed the hearing of the cassation appeal lodged by the General prosecutor’s Office (GPO) of Ukraine to July 26. The GPO appealed the repeal of its decree on institution of criminal proceedings against former President Leonid Kuchma, accused of abuse of power causing the murder of journalist Georgiy Gongadze.

The hearing has been postponed as not all the parties to the trial met certain organizational and procedural requirements for the Court to start the effective hearing, the chairman of the judicial board Myhailo Vilhushynsky announced after hearing of the parties.

"Since it turned out that not all the parties to the trial have complied with the requirements of procedural law, we have every reason not to start the hearing until all the requirements are met. We believe that everyone is equal before the law, so such a judgment is absolutely lawful," the official said.

He also explained that the affected journalist Oleksiy Podolsky has not closed the gaps revealed in his cassation appeal, the lawyer of ex-Major Mykola Melnychenko Mykola Nedilko has not provided the copies of his cassation appeal to all the parties and another lawyer Pavlo Sychev has not get the cassation appeal copies for unknown reasons.

Considering all the facts, the hearing is postponed to July 26, 10.00 a.m.
