From 2012 Ukrainian citizens will not be able to challenge reduction of social benefits in court, Justice Minister Oleksandr Lavrynovych told a press conference, ForUm correspondent reports.

The Minister explained that judges, considering such cases, will have to follow the decision of the Constitutional Court, which has recognized the right of the Cabinet to limit amounts of social benefits proceeding from financial possibilities of the state budget.

"The Constitutional Court is the only body which has a right to interpret the Constitution, and after its decision comes into force all judges without exceptions must follow the decision," the Minister said.
Lavrynovych believes that the given decision of the CC is just for the citizens, as it removes social injustice, namely making it impossible to pay off high pension for one at the expense of others.

As reported, December 29 the Constitutional Court of Ukraine decided that the Cabinet of Ministers has a right to set the amount of social benefits in accordance with financial possibilities of the state.

In particular, the CC recognized as constitutional the paragraph 4 of the regulations of state budget of Ukraine for 2011, according to which the government is given the right to set the amount of social benefits to such categories of citizens as Chernobyl liquidators, children of war and the dismissed from military service.
