President Viktor Yushchenko on Wednesday issued a decree to rescind a governmental resolution on the rules to appoint and dismiss the head and members of the National Communications Regulatory Commission and a resolution to approve its statute.

Yushchenko asked the Constitutional Court of Ukraine to examinethe legality of these resolutions.

President’s Secretariat stated that propositions of Cabinet concerning agreement of President’s decrees with Government are out of Cabinet authorities.

According to article 113 of the Constitution of Ukraine, Cabinet is responsible to President. President is a guarantor of state sovereignty, territorial integrity, Constitution obedience, human and citizens rights and freedom.

Necessity to agree President’s decree with the Government would lead to restriction of possibilities of President’s functions as a guarantor of Constitution and human rights.
