The Parliament of Ukraine adopted the Law "On Ratifying the Council of Europe Convention on Counterfeiting Medical Products and Similar Crimes involving Threats to Public Health". 314 out of 420 MPs registered in the session hall have voted in favor of such decision.
The Convention relates to medical products, regardless of whether they are protected by intellectual property rights or not, or whether they are patented or not, including accessories designed for using along with medical devices, as well as the active agents, excipients, parts and materials intended for usage in the medical products manufacturing.
Under the document, each Party shall take the necessary legislative and other measures to recognize intentional production of counterfeit drugs, active agents, excipients, parts, materials and accessories as crimes.
Under the document, each signatory shall take the necessary legislative and other measures to recognize intentional delivery or proposal on delivery, including mediating, trading, warehousing, importing and exporting of counterfeit drugs, active agents, excipients, parts, materials and accessories as crimes.
Each party shall take the necessary legislative and other measures to establish the requirements of quality and safety of medical products.
The Convention provides for the establishment of the Committee of the Parties, which shall be convened by the Secretary General of the Council of Europe. The first meeting of the Committee shall be held within one year upon the date of entry into force of this Convention for the ten states which have signed and ratified it. The following meetings of the Committee shall be convened at the request of at least one third of the parties or the Secretary General.
The Parliamentary Assembly of the Council of Europe, the European Committee on Crime Problems, as well as other relevant intergovernmental and scientific committees of the Council of Europe shall appoint a representative to the Committee of the Parties to promote multisectoral and multidisciplinary approach.
