University Professor Petro Andrushko has issued findings confirming the
absence of a crime in Yulia Tymoshenko’s actions during the gas crisis
in 2009.
“An analysis of the case as set forth in the indictment gives grounds to conclude that there was no crime in the actions of Tymoshenko Y.V. under Article 365 of the Criminal Code of Ukraine,” the professor wrote in his advisory opinion in reply to a inquiry sent by Yulia Tymoshenko’s lawyer Yuriy Sukhov.
In the opinion of Professor Andrushko, the PGO indictment is built largely on assumptions and the personal judgment of the investigator, rather than evidence.
“The text of the indictment points to a certain level of bias and one-sidedness of the pre-trial investigation,” he concluded.
Professor Andrushko’s finding were added to the case yesterday at the request of the defense.
