The preliminary findings by US law firm Covington & Burling LLP conclude that the criminal case against Yulia Tymoshenko over gas agreements from 2009 is political in nature, the former prime minister's lawyer has said.

"Covington & Burling lawyers found that the allegations in the gas case against Yulia Tymoshenko are not substantiated by facts and questionable from a legal standpoint," Serhiy Vlasenko said at a press conference today, according to Tymoshenko's official website.

According to him, based on an analysis of information set forth in the indictment the lawyers also question the methodology used by the Prosecutor General’s Office to calculate losses allegedly incurred as a result of the signing of the gas contract with Russia in 2009.

Yulia Tymoshenko’s defender pointed out that the American lawyers also noted the refusal by the Prosecutor General’s Office to include as evidence the results of an Ernst & Young audit commissioned by Naftohaz of Ukraine.

"In their conclusions regarding the charges against Yulia Tymoshenko, Covington & Burling, an independent international law firm with an impeccable reputation, absolutely clearly states that there is no legal basis for the continued persecution of Yulia Tymoshenko. Like the charges over the use of Kyoto money and purchase of vehicles for rural health care, these charges are clearly politically motivated," said Serhiy Vlasenko.

According to him, the Covington & Burling reports will be the basis for motions to be filed with the Pechersk District Court of Kyiv.

These documents will also be sent to representatives of all diplomatic missions in Ukraine, the European Commission and European Parliament, and leadership of the US and European states.

"Of course, we will use the findings of Covington & Burling in preparing materials for the European Court of Human Rights," he said.
