Batkivshchyna Party leader Yulia Tymoshenko has announced that she has filed a lawsuit with the U.S. District Court in Manhattan accusing Swiss-based RosUkrEnergo and its co-owner Dmytro Firtash of fraud, violation of human rights and racketeering.

"The court accepted our lawsuit," Yulia Tymoshenko said before going to the Prosecutor General’s Office, Tymoshenko's official website reported.

According to Yulia Tymoshenko, the ruling by the American court will have legal force in Ukraine. "This decision will be absolutely legitimate for any country, or rather, for every legal entity and individual against whom the ruling is issued. This is a legal decision that must be executed," she explained.

Yulia Tymoshenko said she filed the lawsuit as an individual. "I and a number of deputies of our faction filed the lawsuit and the case was submitted to the court a few weeks ago. Today we have confirmation that the court has accepted our lawsuit," she added.

Yulia Tymoshenko noted that according to U.S. law, American courts can accept lawsuits where foreigners sue for violation of their legal rights. "According to United States law, if extortion is committed in a country, if this applies to citizens of Ukraine or any other country, and if this causes personal damages, such as the return of RosUkrenergo led to an increase in gas prices, then such actions can be appealed in American courts," she explained.

In June 2010, the Stockholm Arbitration Court ordered Naftohaz of Ukraine to return to Swiss gas trader RosUkrEnergo, owned by Dmytro Firtash, 11 billion cubic meters of gas plus an additional 1.1 billion cubic meters as penalty.
