President of Ukraine Viktor Yushchenko has no constitutional authorities to declare national referendum by his own initiative concerning changes introductions to the Constitution or adoption of new one.

Olexander Lavrynovych the Justice Minister said that in the statement published on the Justice Ministry site.

He noted that analysis of corresponding norms of the Constitution proves that the President of Ukraine has no Constitutional authorities to hold national referendum by his own initiative. At the same time, the Constitution has that President is obliged to announce the referendum by people’s initiative of at least three million of Ukrainians under condition that signatures of people are from two third of Ukrainian regions, and not less than 100 thousand signatures from each region. Lavrynovych also noted that the Constitution does not foresee directly possibilities of adoption of Essential Law and does not determine corresponding order.
