Secretarial of the President put Moroz in his place

The head of the 5^th comvocation Parliament Olexander Moroz does not have the right to publish any laws enacted by the parliament.

This was announced by the Deputy Head of the President's Secretariat, Ihor Pushkiv, the Press service of the President informed .

In the announcement, specifically, Pushkin’s position regarding the publication on June 19 2007 in the newspaper “Holos Ukraiyiny” with Moroz’s signature the Law of Ukraine “Concerning changes to the Law of Ukraine regarding purchases of goods, services and labour for Government funds" (with the comments photocopy of actual text) were done in contravention of the Constitution of Ukraine.

Referring to statue 88 Essential Law of Ukraine, the removal from power of the Parliament ( in this case the 5^th Convocation) by it’s nature also removes from power it’s Speaker. Therefore Moroz does not have the authority to publish any parliamentary law with his signature, Pushkin said -  UNIAN announced.

The Representative of the Secretariat explained, with the resignation of deputies authorities from Our Ukraine and BYuT on June 3, the VR of Ukraine ceased being in power. “An organ of Government without powers cannot pass laws, and especially, cannot publish them, Pushkin said.

Pushkin explained that (according to Statute # 94 of the Constitution) the Head Parliament has the right to publish under his signature a law that had overturned the Presidential veto and not been signed by the head of State only during the10 days the document was presented for signature. Therefore the mentioned law was published in contravention of the Constitution

Looking at the presentation, publications with Moroz signature the “photocopy” accepted June 19, 2007 by a Parliament without powers changes to the Law “Concerning changes to the Law of Ukraine regarding purchases of goods, services and labour for Government funds” cannot be considered as a valid Law under the current Constitution of Ukraine.
